Role
We are seeking a highly skilled and dedicated Litigation Lawyer specializing in consumer flight claims (typically via small claims procedure) to lead in-court collections, owning or wanting to open their own boutique legal firm in Italy. Pre-court collections are managed by a team of paralegals. You will file batches of court cases to collect compensation and/or reimbursement of Out-of-Pocket Expenses (OPE) incurred by passengers and/or recover ticket refunds. AirAdvisor currently handles three types of airline claims:
- EU261 compensation for flight delays, cancellations, and denied boarding
- Montreal Convention claims for lost, delayed, and/or destroyed luggage
If the law or a judge decides the case unfairly, we would consider escalating this to influence the law where feasible. There may be PR opportunities regarding court victories and essential legal issues to bring to public awareness. This is an excellent opportunity for high performers who can self-perform, have strong litigation experience, and have a passion for advocating consumer rights in the airline industry.
Requirements
- A valid Attorney at Law license in Italy and professional liability insurance.
- A law degree from an accredited institution.
- Experience with small claims, consumer rights, or aviation law is a plus but not required.
- Knowledge of relevant consumer protection laws and aviation regulations is a plus but not required.
- Proven track record of success in in-court collection.
- Strong analytical and problem-solving skills to assess case merits, conduct legal research, and develop effective legal strategies.
- Ability to manage a caseload, prioritize tasks, meet deadlines, and track statute of limitations.
- Experience in automating and standardizing claims management processes to scale up quickly.
Responsibilities
- Act as the legal representative of AirAdvisor in Italy, handling all legal matters and claims filed within the jurisdiction.
- Assist in setting up a law firm in Italy if feasible, including corporate structuring and registrations.
- Pre-court collections and out-of-court settlements.
- Prepare and file batches of approx. 200+ new claims monthly in Italian courts against various airlines for: (a) Compensation under EU Regulation 261/2004 and/or Turkish SHY Regulation for delays/cancellations/denied boarding; (b) Reimbursement of out-of-pocket expenses under EU261/2004 and/or Montreal Convention; (c) Ticket refunds under applicable frameworks; (d) Handle baggage-related claims under Montreal/Warsaw Conventions.
- Respond to airline defenses with substantive and procedural arguments. Lead enforcement of court judgments and coordinate with enforcement authorities as needed.
- Engage in court-led settlement negotiations and represent AirAdvisor’s interests in favorable settlements.
- Maintain complete and accurate legal case files in compliance with Italian ethics and data protection regulations.
- Conduct thorough legal research and comparative analysis to identify best practices in airline and consumer rights litigation.
- Stay informed about developments in consumer protection law, aviation regulations, EU regulations, and precedents to provide updated legal advice.
- Pursue legal remedies, including appeals, if decisions are unjust, and advocate for legislative changes where feasible.
- Support optimization and automation of claims management workflows using legal tech, including AI-based tools.
- Identify and propose new high-volume, low-value civil claims opportunities under Italian law.
- Conduct cross-jurisdictional research across EU/UK to adapt precedents for Italy in complex scenarios.
- Represent AirAdvisor in local media when needed and coordinate with PR for public awareness of consumer rights.
- Review and vet content as in-country reviewer to build trust and authority.
- Advocate for passenger and consumer rights in the airline and travel industry.
