Offer Description

The project aims at examining the structure and function of accusation in the criminal cognitio extra ordinem of the classical period,highlighting its differences from the accusatory model of the quaestiones. The research will focus on the persons entitled to bring an accusation, the procedures governing the initiation and conduct of the accusatio,the powers vested in the magistrate/official exercising the cognitio, and the relationship between private initiative and intervention by public authorities.Through an analysis of legal/literary sources, the project will investigate the extent to which the extra ordinem procedure retained elements of the traditional accusatory structure whilesimultaneously reflecting a progressive transformation in the role of the accuser and the judge.Particular emphasis will be placed on the consequences of this transformation for the protection of the accused and for the balance between the initiative of the parties and the powers of the judicial authority
